Getting what you desire: the normative significance of genetic relatedness in parent–child relationships

Abstract

People who are involuntarily childless need to use assisted reproductive technologies if they want to have a genetically related child. Yet, from an ethical point of view it is unclear to what extent assistance to satisfy this specific desire should be warranted. We first show that the subjectively felt harm due to the inability to satisfy this reproductive desire does not in itself entail the normative conclusion that it has to be met. In response, we evaluate the alternative view according to which the satisfaction of this desire is regarded as a way to meet one’s presumed intermediate need for parenthood. This view presupposes that parenthood is one of those general categories of experiences and activities that contribute an irreplaceable value to people’s lives, but the central difficulty is to find those characteristics that mark out parenthood as an irreplaceable constituent of a valuable life. We go on to argue, however, that even if one assumes that parenthood is such an irreplaceable constituent that makes life more valuable, this does not necessarily entail a moral duty to satisfy the desire for genetic parenthood. We conclude that there is a pro tanto obligation to help people conceive a genetically related child (if this is what they prefer), but that this can be outweighed by other moral considerations, such as safety and justice concerns.

Haslanger’s (2009) argument, for instance, includes reference to empirical findings about adopted children and their motivation to search information about biological relatives. She grants that such information can help meet so-called identity needs, though it does not necessarily entail a desire for a relationship, let alone a conclusion that children have to be raised by their genetic parents. Moreover, longitudinal research by Golombok et al. (2013) has shown that absence of a genetic connection to the parents does not negatively affect the child’s wellbeing, so this cannot be used as an argument against non-genetic parenthood alternatives. In line with this, Di Nucci (2016) has added that access to one’s family history may indeed be important for one’s identity formation, but that the “narrative significance of such access does not depend on the family being one’s biological family”.

There are more elaborate lists which can be found in e.g. Doyal and Gough (1991) and Miller (2012). Since we focus here on how these categories are invoked with reference to the desire for genetic parenthood, we will not go into the details of these categories. Importantly however, it should be noted that some intermediate needs (like the ones for nutrition and shelter) are more fundamental than others, as they are necessary conditions to be able to meet other intermediate needs (like the ones for significant primary relationships, entertainment and self-realization).

Implying that (1) there may be cases of parenthood that lack those typical characteristics of parenthood which make it valuable and that (2) there may be cases in which someone derives the value of parenthood from a relationship with a child of which one is strictly speaking not the parent, for example when someone takes care of a foster child.

An example of such (re)negotiation is the shift in legal and public perception of same-sex relationships as a legitimate way of meeting one’s intermediate need for primary significant relationships. This is partly based on the argument that sexual expression is an important aspect of one’s identity formation. The efforts of the activist movement from the 1970s until now illustrate how desires can gain recognition as a result of social and moral negotiations by appealing to more generally shared values (Manion 2012). This does not exclude, however, that there are limits to such (re)negotiations. For instance, a renegotiation of paedophilia as a way of sexual expression and a respective claim for desire satisfaction is very unlikely to pass in view of other ethical values and interests (which may also trump appeals to personal autonomy; see below).
