Marktzugang, Erstattung und Preissetzung neuer patentgeschützter Arzneimittel in der Europäischen Union

Zusammenfassung

Preissetzung und Erstattung für neue patentgeschützte Arzneimittel in Deutschland unterscheiden sich in einigen wenigen, aber relevanten Punkten von anderen europäischen Ländern. In Deutschland kann ein Arzneimittel nach Vorliegen der Zulassung unverzüglich auf den Markt gebracht werden; es ist im ersten Jahr grundsätzlich erstattungsfähig und kann zu einem vom pharmazeutischen Unternehmer bestimmten Preis angeboten werden. Dies ist in keinem anderen europäischen Land in dieser Form möglich. Abgesehen von Dänemark und Großbritannien entscheiden in anderen Ländern die Behörden vor Markteintritt eines patentgeschützten rezeptpflichtigen Medikaments über dessen Erstattungsfähigkeit und (Erstattungs-)Preis. Zentrale Methode der Preisregulierung ist in den meisten europäischen Ländern die internationale Preisreferenzierung (d. h. Berücksichtigung von Preisen desselben Arzneimittels in anderen Ländern), die allerdings bei hochpreisigen Medikamenten meist nur als erster Schritt angewandt und in der Folge um vertrauliche Rabattverträge ergänzt wird. Rabattabkommen werden in anderen Ländern vor allem für hochpreisige patentgeschützte Arzneimittel abgeschlossen und nicht – wie in Deutschland – im generikafähigen Markt. Um nachhaltig Zugang zu neuen Arzneimitteln zu erschwinglichen Ausgaben zu gewährleisten, setzen eine Reihe von europäischen Staaten auf länderübergreifende Kooperation in den Bereichen Horizon Scanning, Health Technology Assessment (HTA), Informationsaustausch und gemeinsame Preisverhandlungen. Deutschland zählt mit seiner frühen Nutzenbewertung und seiner elaborierten Vorgehensweise zu den führenden HTA-Anwendern in Europa, hingegen wurde noch kein offizielles Horizon Scanning-System etabliert.
